# Terms of Service

Welcome to Scarlight X. These Terms of Service ("Terms") apply to your use of scarlightx.com (the "Site") and any purchase you make from us. The Site is operated by Jeremy Schwegmann, a sole proprietor doing business as Scarlight X, in San Antonio, Texas, USA ("we," "us" or "our"). By using the Site or placing an order, you agree to these Terms.

## 1. Using the Site

You must be at least the age of majority where you live, or have a parent's or guardian's permission, to place an order. You agree not to use the Site for anything unlawful, to interfere with its security or operation, or to copy or scrape its content without permission.

## 2. Products

Our products are made to order by production partners. We do our best to show colors, designs and details accurately, but colors can look different on different screens, and small variations in printing and placement are normal for custom-made items. Product photos may be digital mockups.

## 3. Prices and payment

Prices are listed in US dollars and may change at any time without notice. Applicable taxes and shipping are shown at checkout. We may refuse or cancel any order, including if a product is mispriced, unavailable, or we suspect fraud. If we cancel an order after you've paid, we'll refund you in full.

## 4. Orders, shipping and refunds

Shipping is covered by our Shipping Policy and returns, refunds and cancellations by our Refund & Return Policy. Both are part of these Terms.

## 5. Intellectual property

All designs, artwork, text, photos and other content on the Site belong to Scarlight X or its licensors and are protected by copyright and other laws. Buying a product gives you the item itself, not the right to copy, resell or reproduce the design.

## 6. Reviews and messages

If you send us reviews, photos, ideas or other content, you give us permission to use, display and share it in connection with our store and marketing, and you confirm you have the right to share it. We may remove content that is unlawful, offensive or misleading.

## 7. Third-party links and services

The Site runs on Shopify and may link to third-party sites or services. We aren't responsible for their content or practices.

## 8. Disclaimer

The Site and products are provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. This doesn't affect any rights you have that can't be waived under the law where you live.

## 9. Limitation of liability

To the fullest extent allowed by law, Scarlight X won't be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some places don't allow these limits, so they may not fully apply to you.

## 10. Indemnity

You agree to hold Scarlight X harmless from claims arising from your breach of these Terms or misuse of the Site.

## 11. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Bexar County, Texas, unless the law where you live gives you the right to bring a claim in your local courts.

## 12. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on the Site, and continued use of the Site means you accept them.
